PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

This Privacy Notice applies to California residents ("consumers" or "you") only and supplements the information in Testosterone Shots, PC's general Privacy Policy. We adopt this notice to comply with the California Consumer Privacy Act of 2018 ("CCPA"), the California Privacy Rights Act of 2020 ("CPRA"), and other applicable California privacy laws. Any terms defined in the CCPA or CPRA have the same meaning when used in this notice.

INFORMATION WE COLLECT

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device ("Personal Information").

We have collected the following categories of Personal Information from California consumers since January 1, 2023:

Identifiers.

Name, date of birth, email address, phone number, mailing address, IP address, account username, device identifiers, and cookies or similar online identifiers.

Personal Information Categories Listed in the California Customer Records Statute (Cal. Civ. Code § 1798.80(e)).

Name, address, telephone number, medical information, health insurance information, and payment card information. Some personal information included in this category may overlap with other categories.

Characteristics of Protected Classifications Under California or Federal Law.

Age, gender, and other protected characteristics as voluntarily provided in connection with your healthcare intake.

Commercial Information.

Purchase history, subscription plan information, treatment program enrollment, transaction records, and billing information related to services purchased through the platform.

Health and Medical Information (Sensitive Personal Information).

Clinical history, current and past medical conditions, medications, laboratory results, hormone levels, diagnostic test results, prescription history, and other health information provided in connection with telehealth consultations and treatment.

Internet or Other Similar Network Activity.

Browser type, device type, IP address, cookies, pages visited, time spent on pages, interaction with the website, app usage, and email and chat transcripts related to customer service communications.

Geolocation Data.

General location derived from IP address; precise location only if voluntarily provided.

Sensory Data.

Audio recordings of phone calls with customer support (where permitted by law).

Professional or Employment-Related Information.

Occupation, as voluntarily provided during intake.

Inferences Drawn From Personal Information.

Treatment preferences, health goals, communication preferences, and inferences drawn to provide personalized healthcare recommendations.

We obtain the categories of Personal Information listed above from the following sources:

- Directly from you when you register, complete intake forms, communicate with us, or make a purchase.

- Automatically as you navigate through our website and platform (e.g., cookies and usage tracking).

- From third parties involved in your care, such as licensed compounding pharmacies, laboratory networks, and other healthcare providers.

- From payment processors and fraud prevention services in connection with transactions.

Personal Information does NOT include:

- Information lawfully made available from federal, state, or local government records.

- De-identified or aggregate consumer information.

- Health or medical information covered by HIPAA and the California Confidentiality of Medical Information Act (CMIA) — to the extent such information is excluded from the CCPA's scope.

- Information excluded by other sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA) and the Gramm-Leach-Bliley Act (GLBA).

Sensitive Personal Information.

Under the CPRA, the following categories of information we collect are considered "Sensitive Personal Information":

- Social Security number, driver's license, state ID, or passport number.

- Account login credentials in combination with security codes or passwords.

- Precise geolocation data.

- Health and medical information, including information collected and analyzed concerning your physical condition, diagnoses, and treatments.

- Racial or ethnic origin, as may be incidentally disclosed in medical intake.

- Contents of mail, email, and text messages unless we are the intended recipient.

USE OF PERSONAL INFORMATION

We may use or disclose the Personal Information we collect for the following business purposes:

- To fulfill or meet the reason for which the information is provided.

- To provide, manage, and improve our telehealth services and to offer health and wellness products or services relevant to your care.

- To coordinate prescription fulfillment with licensed compounding pharmacies.

- To coordinate laboratory orders and deliver lab results.

- To process payments and manage billing and subscriptions.

- To communicate with you about appointments, treatment updates, lab results, and account activity.

- To provide you with email alerts and notices concerning our products, services, or events that may be of interest to you.

- To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collections.

- To improve our website and platform and to conduct testing, research, analysis, and product development.

- To protect the rights, property, or safety of us, our clients, or others.

- To respond to regulatory and/or law enforcement requests and as required by applicable law, court order, or governmental regulations.

- To third-party service providers who perform marketing or other services on our behalf.

- To our affiliates and subsidiaries.

- As otherwise required or permitted by law.

We will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

SHARING PERSONAL INFORMATION

We may disclose your Personal Information to third parties for a business purpose. In the preceding twelve (12) months, we have disclosed the following categories of Personal Information for a business purpose:

- Identifiers

- California Customer Records personal information categories

- Commercial information

- Health and medical information

- Internet or other similar network activity

- Geolocation data

- Inferences drawn from Personal Information

We disclose your Personal Information for a business purpose to the following categories of third parties:

- Our affiliates and subsidiaries

- Service providers and vendors (e.g., payment processors, analytics providers, customer support tools)

- Licensed compounding pharmacies fulfilling prescriptions written by your Provider

- Laboratory networks processing diagnostic test orders

- Licensed healthcare providers and clinical staff involved in your care

- Third parties to whom you authorize us to disclose your Personal Information

- Other third parties as required or permitted by law

SELLING OR SHARING PERSONAL INFORMATION

We do not sell your Personal Information for monetary consideration.

However, under the CPRA's broad definition, sharing your Personal Information with third-party advertising and analytics providers (such as Meta Pixel and Google Analytics) for cross-context behavioral advertising may constitute "sharing" under California law. You have the right to opt out of such sharing. See "Your Rights and Choices" below.

YOUR RIGHTS AND CHOICES

The CCPA and CPRA provide California residents with the following rights regarding their Personal Information:

1. Right to Know.

You have the right to request that we disclose the categories and specific pieces of Personal Information we have collected about you, the categories of sources from which it was collected, our business or commercial purpose for collecting or sharing it, and the categories of third parties with whom we share it.

2. Right to Access (Data Portability).

You have the right to receive a copy of the specific pieces of Personal Information we have collected about you in a portable, readily usable format.

3. Right to Correct.

You have the right to request that we correct inaccurate Personal Information we maintain about you.

4. Right to Delete.

You have the right to request that we delete your Personal Information from our records and direct our service providers to delete your Personal Information, subject to certain exceptions described below.

5. Right to Opt Out of Sale or Sharing.

You have the right to opt out of the sale of your Personal Information and the sharing of your Personal Information with third parties for cross-context behavioral advertising purposes. 6. Right to Limit Use of Sensitive Personal Information.

You have the right to request that we limit our use and disclosure of your Sensitive Personal Information to uses necessary to perform the services you request, ensure security and integrity, conduct non-personalized advertising, and perform other permitted purposes under the CPRA.

7. Right to Non-Discrimination.

We will not discriminate against you for exercising any of your CCPA or CPRA rights. We will not deny you goods or services, charge you different prices, provide a different level of quality, or suggest that you will receive different treatment as a result of exercising your privacy rights.

Deletion Request Exceptions.

We are not required to comply with a deletion request if retaining your Personal Information is necessary to:

- Complete the transaction for which the Personal Information was collected or fulfill a contract with you.

- Detect security incidents, protect against malicious or fraudulent activity, or prosecute those responsible.

- Debug products to identify and repair errors.

- Exercise or ensure free speech rights or other rights provided by law.

- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.).

- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest, when deletion may render such research impossible.

- Enable solely internal uses reasonably aligned with your relationship with us.

- Comply with a legal obligation.

- Make other internal and lawful uses of the information compatible with the context in which it was provided.

Only you, or a person registered with the California Secretary of State whom you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. Your request must provide sufficient information to allow us to reasonably verify your identity and describe your request with sufficient detail for us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request. Making a verifiable consumer request does not require you to create an account with us.

Authorized Agents.

You may designate an authorized agent to make a request on your behalf. To use an authorized agent, you or your agent must submit proof that the agent is registered with the California Secretary of State and is authorized to act on your behalf, or provide a power of attorney executed pursuant to the California Probate Code.

RESPONSE TIMING AND FORMAT

We endeavor to respond to a verifiable consumer request within 45 days of receipt. If we require more time (up to an additional 45 days), we will inform you of the reason and the extension period in writing. Any disclosures we provide will cover the 12-month period preceding the verifiable consumer request's receipt.

For data portability requests, we will provide your Personal Information in a format that is readily usable and allows you to transmit the information from one entity to another without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will provide you with a cost estimate and rationale before completing your request.

CHANGES TO THIS NOTICE

We reserve the right to amend this Privacy Notice at our discretion and at any time. When we make changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you by email or through a notice on our website.
